Program Description
This session covers the latest trends in association law, including legal considerations associated with adopting and administering enforceable leasing restrictions and statutory limitations on associations’ authority to regulate alternative energy components. Further, implications and liabilities that social media, green initiatives, technologies and conservation methods will be addressed.
Speakers
David Graf has practiced community association law exclusively since 2001. In this time, he has represented a wide range of communities throughout the State of Colorado. The majority of his practice involves interpreting and amending governing documents, advising associations on the corporate aspects of running a common interest community, and enforcing the terms of governing documents through court action. He has attended countless difficult and contentious board and member meetings on behalf of associations. David has lectured on various aspects of community association and corporate law throughout the state and has taught continuing legal education courses on the topic of “community association law” to attorneys several times. David is also a national faculty member of the Community Associations Institute’s Professional Management Development Program. David has served on the Colorado Legislative Action Committee of the Rocky Mountain Chapter of the Community Association Institute for many years and currently serves as the co-chair of the Committee.
Steven Sugarman is the founding principal of the law firm of Steven L. Sugarman & Associates, with offices located in Berwyn, Philadelphia, Lancaster and Allentown, Pennsylvania and Cherry Hill, New Jersey. He concentrates his practice in the field of community association law, real estate and construction litigation. Mr. Sugarman is a member of the College of Community Association Lawyers and a past president of the Community Associations Institute (CAI), Pennsylvania/Delaware Valley Chapter. He is also a member of the American and Pennsylvania Bar Associations and the American and Pennsylvania Associations for Justice. Mr. Sugarman has been awarded Martindale Hubbell's highest AV Preeminent peer review rating and has been featured as a Pennsylvania "Super Lawyer" in Philadelphia magazine every year since 2007. A past and current chairman of CAI's Legislative Action Committee in Pennsylvania, Mr. Sugarman actively participates in the drafting of key legislation governing common interest communities, and his writings include the article, "Setting the Standard of Care in Premises Liability Cases," published in CAI's Journal of Community Association Law..
Raymond Via, Esq.,For more than 25 years, Raymond Via, Esq., has represented condominium and homeowners associations throughout Maryland and the District of Columbia with Whiteford Taylor Preston. He is experienced in all facets of association representation, including drafting and amending governing documents and has successfully litigated numerous cases involving community associations in both trial and appellate courts. Raymond is a past member of the Board of Directors of the Washington Metropolitan chapter of CAI and a past president of the Board of Directors of CAI’s Chesapeake chapter. He has written and lectured extensively on community association issues and regularly teaches homeowner education courses. He has also served as a delegate to the Maryland Legislative Action Committee.
E. Richard Kennedy, Esq. specializes in complex civil litigation and mediation, including construction defect and director and officer liability litigation. He is a Certified Civil Trial Attorney by the New Jersey Supreme Court, a Fellow of the American College of Civil Trial Mediators and a member of Litigation Counsel of America. One of his areas of concentration in construction law is representing condominium associations and planned unit developments. He has represented these Associations in all aspects including as
general counsel, transition and as a trial attorney since 1975.
