Program Description
The statutory limited lien priority in 22 states and the District of Columbia is under assault by Fannie Mae, Freddie Mac, and the Federal Housing Finance Agency. CAI is defending this vital tool as an amicus curiae and through political strategies. This session explains the latest cases and issues in dealing with loan servicers, federal agencies and their allies, and takeaway practice advice on how to protect your associations’ rights.
Speakers:
Robert M. Diamond has practiced real property law in Virginia, Maryland and the District of Columbia for over 40 years, with special emphasis on preparing documents for condominiums, planned communities and mixed-use projects for developers, negotiating warranty and construction defect claims, representing community associations and litigating association-related issues in state and federal courts. He has been a dedicated volunteer within CAI, serving as President of the national organization and the Washington Metropolitan Chapter.
Jaime K. Fraser, since 2009, has almost exclusively represented community associations between her practice in New Jersey and Pennsylvania at McGovern Legal Services, LLC, and in Missouri after moving to St. Louis in March 2015 and joining the Nodiff & Billy firm. Ms. Fraser has provided comprehensive representation to condominium and homeowner associations, handling numerous collection cases, construction defect litigation and general corporate matters. She has helped prepare amicus briefs for CAI in the Ninth Circuit on issues involving the limited lien priority.
Stephen M. Marcus is a partner at Marcus, Errico, Emmer & Brooks of Braintree, Massachusetts, serving Mass. RI and NH. He works in the Condominium, Homeowners' Association and Real Estate Development Groups, representing community associations, developers and lenders in a wide-ranging practice that includes: Reviewing, drafting and amending condominium documents; negotiating the terms of condominium association loans; advising boards on rules
enforcement, association insurance and other condominium governance issues; and developing both market-rate and affordable housing.
Attorney Marvin J. Nodiff has represented community associations in the metropolitan St. Louis area and across Missouri for more than 30 years. He is a charter fellow in CAI's College of Community Association Lawyers, served on CAI's board of trustees for six years, and was founding editor of the Journal of Community Association Law. Nodiff was a founding member of the Heartland Chapter and served twice as its president. He taught community association law as an adjunct professor at St. Louis University School of Law for seven years and has authored numerous articles in legal publications and Common Ground.
