Recent developments in the implementation and enforcement of the Fair Housing Amendments Act of 1988 as applied to community associations will—and in some cases, already are—presenting significant challenges for associations, board members, management companies, and managers. This session discusses the proposed U.S. HUD rules regarding “quid pro quo” and “hostile environment” harassment, as well as disparate impact issues, which may limit an association’s ability to reject proposed occupants “for cause.”

Recent developments in the implementation and enforcement of the Fair Housing Amendments Act of 1988 as applied to community associations will—and in some cases, already are—presenting significant challenges for associations, board members, management companies, and managers. This session discusses the proposed U.S. HUD rules regarding “quid pro quo” and “hostile environment” harassment, as well as disparate impact issues, which may limit an association’s ability to reject proposed occupants “for cause.”
Speakers:
Michael E. Chapnick, Esq. joined the firm in 2015 after he founded and managed the Boca Raton-based law firm of Chapnick Community Association Law from 2004 to 2015. Under his leadership, the law firm grew to become a highly successful and respected boutique practice focusing exclusively on community association law and serving more than 300 associations primarily in Palm Beach County.
Michael L. Hyman, Esq. is the co-author of Florida Condominium Law & Practice, published in October, 1986, by Matthew Bender & Co., a comprehensive work in the area of condominium associations operations.
Scott D. Weiss, Esq. is an attorney at Weiss & Weiss, Attorneys at Law in Nashville, Tennessee. His practice is dedicated primarily to the representation of homeowner and condominium associations throughout Tennessee.
