As homeowners struggle to keep up with their mortgages and pay their assessments, associations too have been backed into a financial corner. Squeezed by increasing costs and delinquencies, more associations are finding it necessary to take legal action to remain financially viable. While most associations only pursue foreclosure as a last resort, an increasing number of associations have reached that point. Angry, surprised and sometimes rightfully suspicious, homeowners are pushing back and filing legal actions of their own against associations and management companies for what they believe are wrongful foreclosure actions.

Marc D. Markel, Esq., is a shareholder of the Texas law firm of Roberts Markel P.C. with offices in Houston, San Antonio, Sugar Land, Dallas and Beaumont. He attended South Texas College of Law and was licensed to practice law in 1979. He is Board Certified in Residential and Commercial Real Estate Law by the Texas Board of Legal Specialization and is a Member of the College of the State Bar of Texas. Marc is also a certified mediator and acts upon request as an arbiter. Marc is a charter member of the College of Community Association Lawyers; a member of CAI's national faculty; a past member of CAI's national Board of Trustees, and Past President of the Foundation for Community Association Research.
