Program Description
This program addresses the complexity of properly investigating construction defect claims. It will cover expert retention/contracts and evidence gathering, and discuss mistakes made by lawyers and experts that can be fatal to a case. The program will examine the liabilities attorneys face in retaining experts and how to structure fee agreements to minimize attorney liability in expert retention. Techniques for gathering evidence will be discussed, including chain of custody issues and joint investigations with developers/subcontractors.
Speakers
Jon H. Epsten, Esq., is the founding shareholder in the law firm of Epsten Grinnell & Howell, APC. For years, Mr. Epsten acted as a community association manager. He has attended thousands of association board meetings. Mr. Epsten’s work on behalf of community associations encompasses providing advice on all types of corporate matters including directors' and officers' defense, mold and mildew litigation, interpretation and enforcement of governing documents, assessment collection, construction defect litigation, and reconstruction issues.
A. Judson Taylor, AIA, LEED™ AP, is an architect registered by the State of California, and is a principal of Simpson Gumpertz & Heger Inc. (SGH). Mr. Taylor currently serves as the head of SGH’s Los Angeles Building Technology division. Mr. Taylor is a specialist in the design and construction of building envelope materials and systems, in all aspects of construction.
