Program Description
Discussion and analysis of voting methods authorized, required or prohibited throughout the United States for community association elections concerning, among other things the election and removal of directors or the authorization of action, including the amendment of governing documents, imposition of assessment increases, acquisition of bank loans and the initiation of litigation.
This program will address voting in person, by proxy, by written ballot, secret ballot and electronically, as well as typical problems encountered in the voting process and how best to minimize successful legal challenges when problems arise.
Speakers
Steve S. Weil, Esq. has practiced community association law since 1984 and has dealt with virtually every kind of challenge facing directors, managers and community association members. These have included analyzing board and member duties under the Davis-Stirling Common Interest Development Act and other state and federal laws, helping communities deal with CC&R amendments and director recalls and campaigns for large special assessments to fund capital improvements or major repairs.
David J. Graf, Esq. is a partner at Moeller Graf, P.C. in Englewood, Colorado. David Graf has practiced community association law exclusively since 2001. In this time, he has represented a wide range of communities throughout the State of Colorado. The majority of his practice involves interpreting and amending governing documents, advising associations on the corporate aspects of running a common interest community, and enforcing the terms of governing documents through court action. He is a member of CAI’s legislative action committee for the state of Colorado. David is also a national faculty member of CAI’s Professional Management Development Program.
