Program Description
You may have wondered about whether a Community Association can file for bankruptcy relief. This session will answer that question in a way that will allow you to competently advise managers and board members on this topic. The presenters will walk you through an actual community association Chapter 7 bankruptcy case from the filing to the point of dismissal, including the introduction to actual pleadings filed in the case.
You will be introduced to the filing options for a Community Association, the issues that arise in a Community Association bankruptcy, both Chapter 7 and Chapter 11, and the ultimate answer to the question - can a Community Association bankruptcy file for bankruptcy relief?
Speakers
John D. Morris, Esq. of Morris Sperry, is one of Utah’s foremost attorneys in the field of community association law. He is also one of less than 150 nationwide members of the Community Association Institute College of Community Association Lawyers (CCAL). Mr. Morris was also recently elected President-elect of the Board of the local chapter of the Community Association Institute, where he continues his voluntary efforts. He also continues his long standing service on the Utah CAI Legislative Action Committee (a non-partisan organization dedicated to furthering the legislative interests of the community association constituency), a committee he chaired for three years. He is a founding member of Morris Sperry, the only law firm in the state of Utah focused entirely on community association law.
Quinn A. Sperry, Esq. serves on the Communications Committee of the Utah chapter of the Community Associations Institute. He is one of the founding members of Morris Sperry, the only Utah law firm focused exclusively on community association law. He is responsible for the oversight of the collection practice at Morris Sperry and has entered appearances in over 200 bankruptcy cases. His practice also includes all aspects of community association law including document rewrites, litigation, governance issues, and general advice.
