Program Description
This panel will explore and discuss three critical challenges that are merging to create a host of headaches and mortal threats to community association lawyers and their clients. 2013 saw the emergence of new, large scale legal threats on the collections front, spurred in part by federal programs designed to ameliorate the housing crisis.
Big banks buying up foreclosed homes are suing HOAs to avoid paying statutorily required priority liens, aggressive plaintiff’s attorneys are bringing novel and expensive suits against community association lawyers and state legislators continue to erect barriers for community associations seeking to collect past due assessments. This session will provide an overview of the current state of the law and a discussion on community association attorneys can navigate a treacherous sea of challenges. Speakers
Sandra L. Gottlieb, Esq. is one of California’s leading community association attorneys and a founding partner of the law firm of SwedelsonGottlieb, which limits its practice to the representation of California homeowner associations, including condominiums, planned developments and cooperatives. Ms. Gottlieb has long been a prominent name in the community association industry, having served as President of the board of directors of three chapters of the Community Associations Institute (CAI) in Los Angeles, Orange County and Channel Islands. On a national level, she represents the firm on the CAI National Faculty, the CAI National Attorneys Committee, and the CAI College of Community Association Lawyers (CCAL).
Shawn Siders, Gall & Siders, PLLC: Prior to his legal career, Shawn had a successful career in city planning working for several municipal governments and a national homebuilder. During his extensive planning career, Shawn became well versed in land development processes and real estate law to navigate through complex new development projects and to maximize value during difficult economic times. Shawn also established and managed all Common Interest Communities during his employment with the national homebuilder.
Lucia Anna Trigiani, Esq. practices common interest ownership community association law. This includes representation of community associations, real estate developers of common interest ownership community associations, Virginia real estate brokerage licensing law, and legislative representation.
Andrew S. Fortin, Esq. - Moderator - is the Vice President of Government and Public Affairs for Associa. In his role is he responsible for engaging local, state and federal legislators in states where Associa has branch offices. Prior to his work with Associa, Mr. Fortin lead CAI's Government & Public Affairs Department, served as staff liaison to the College of Community Association Lawyers and founded CAI's federal legislative programs
