Program Description
This session addresses the use of fact and expert witnesses by community associations in litigation. It covers preparing fact witnesses, selecting expert witnesses, formulating an expert report, protecting work product/privilege, admission of the expert report, related motion practice and using the expert at trial.
Speakers
Jennifer Barnett, Esq. is a partner at Marcus, Errico, Emmer & Brooks PC in the Litigation Department, concentrating her practice in the areas of civil and appellate litigation, condominium law and real estate law. Before joining the firm in 2005, she served as Law Clerk for Chief Justice Karyn F. Scheier of the Commonwealth of Massachusetts Land Court, where she gained valuable experience in virtually all areas of real estate law. Jennifer is a member of the National Association of Women in Construction. Jennifer is also active within the New England Chapter of the Community Associations Institute, serving as co-chair of the chapter’s Programs Advisory Committee, and she is also a frequent chapter speaker.

E. Richard Kennedy, Esq. of Kennedy Wronko Kennedy is a member of the Community Associations Institute and a Charter member of the College of Community Association Lawyers serving as its Dean and a member of the Board of Governors (1993-1997). He was a national trustee for CAI and a past President of CAI's National Research Foundation. In 1996 he was awarded CAI’s “Outstanding Volunteer Award”. He was president of the New Jersey CAI Chapter in 1989. He is past Editor of CAI’s Journal of Community Association Law. He received the distinction of the CAI Distinguished Service Award in May of 2014. He has been a presenter at fourteen (14) National Law Seminars and is presently the Co-Chair for the 2015 CAI Law Seminar..
