Historically, restrictions were based on the premise that rentals are detrimental to property values. Now restrictions based on age, single families, number of occupants, sexual predators and others are being adopted for the same reasons. Historically, restrictions were based on the premise that rentals are detrimental to property values. Now restrictions based on age, single families, number of occupants, sexual predators and others are being adopted for the same reasons. This session examines drafting and enforcing such restrictions.
Speakers
Gregory Chandler joined Eads Murray & Pugh in April 2008. He devotes almost the entirety of his legal practice to serving community associations in multiple capacities, including collections, foreclosure litigation, bankruptcies and covenant enforcement litigation, as well as corporate governance and transactional matters such as document drafting, covenants and by-laws amendments, drafting and interpreting contracts, developing association rules and ensuring compliance with state and federal laws. He is a frequent speaker on community association matters for such entities as the Central Indiana Chapter of the Community Associations Institute and Association Help Now, and he regularly authors articles about issues impacting community associations and board members. Greg often spends evenings and weekends attending association meetings and speaking at educational seminars throughout central Indiana. An educator at heart, he truly enjoys spending time educating board members and helping them become more effective officers of their communities.
Courtney S. Figg joined Eads Murray & Pugh as an associate attorney in April 2012. She focuses her practice on community association law where she represents clients in a variety of litigation matters, including covenant enforcement actions, injunctions, collections, and lien foreclosures.As a member of the Community Associations Institute (CAI) Central Indiana Chapter, Courtney is active on the Legislative Action Committee, which represents the interests of community associations before the Indiana General Assembly and tracks legislation at the state and national levels that impacts community associations. Courtney routinely presents at educational seminars hosted by the CAI Central Indiana Chapter and authors articles of interest to community associations for the Association Help Now publication.
Robert Kmiecik, Partner, Kaman & Cusimano: Bob’s background and personal experience uniquely qualifies him to represent community associations. Upon graduation from law school, he centered his attention on litigation, serving four years as an Assistant Prosecuting Attorney and an Assistant Director of Law for the City of Cleveland. Thereafter, he worked nine years in private practice, including work for a large insurance defense firm and as a supervising trial attorney for a firm involved in mass tort litigation. Bob’s civil and criminal litigation background has provided him with valuable experience in litigating developer and contractor repair and construction defect cases, as well as covenant and rule enforcement matters, including obtaining restraining orders and injunctions against owners and residents who commit violations. Bob currently lives within a homeowner association.
