When the association, the board of directors and/or the community association manager receives a demand or is served with a lawsuit, the potential financial impact on the association’s assets is significant. What must counsel do to determine who will pay the potentially significant defense fees and cost? This session presents a logical sequence for reviewing insurance, contracts and indemnity agreements to make sure each potential source for funding the client’s defense is revealed. In addition, a risk management audit checklist is provided to help maximize potential funding before a suit or demand arrives.

Speakers:
Joel Meskin, Esq., CIRMS, is vice president of community association insurance and risk management at McGowan Program Administrators. He earned CAI’s Community Insurance and Risk Management Specialist (CIRMS) designation in 2005 and is a member of CAI’s Insurance Networking Committee.In 2014, Joel was accepted as a member of CCAL. Joel has been closely involved with community associations and the community association management business for many years, insuring more than 75,000 associations nationwide, producing insurance policy products and engaging in risk management.
David S. Kasdan is an experienced Senior Attorney at Chubb's Manhattan House Counsel office of Hoey, King, Epstein, Prezioso & Marquez. Over the past two decades he has represented national banking institutions, real estate developers and sponsors, property managers, mortgage brokers, title agents and escrow agents, and a broad cross section of business entities and not-for-profit boards of directors..
